Here's an update on the cottage food laws across the nation.
California
California bakers asked California state legislators to enact a Cottage Foods bill authorizing the Department of Health and Senior Services and/or the Department of Agriculture to issue customized "Home Bakery" licenses to residential kitchens for the purpose of selling non-potentially-hazardous bakery products, such as, but not necessarily limited to: breads, cakes, doughnuts, pastries, buns, rolls, cookies, biscuits, and pies (except meat or cream pies).

Washington State

South Dakota

Maryland
Delegate Mary Ann Lovefrom Maryland is introducing a bill to the MD legislature to legalize home kitchens again this year. Write to your Maryland delegates and ask them to become a cosponsor to this bill. (To find your delegates, go to http://mdelect.net/) Sign the petition at and ask other Maryland bakers to sign.

Not potentially hazardous and prepared in a kitchen of a private home for commercial purposes if it is packaged with a label that clearly states the address of the maker, includes contact information, lists the contents and discloses that the product was prepared without government inspection.

Comment by Denay Davis on July 18, 2011 at 4:38pm The Sustainable Economies Law Center up in the Bay Area will be meeting this week with State Senator Mark DeSaulnier to begin the process of drafting a Cottage Food Law for California. The Los Angeles Bread Bakers (which is on Facebook and Meetup) is organizing in Southern California around the need for this law and welcomes the support of all home bakers. Bear in mind that even bake sales are currently illegal in California.

On Monday, Nov. 21, 2011 the NJ Senate Health, Human Services and Senior Citizens Committee will be hearing S2734 - Permits sale of home-baked goods under certain circumstances. The hearing will take place in Trenton at the State House Annex.State House Annex Welcome Center, 145 West State Street, 1st Floor Room #1, Trenton, NJ 08608 - 609-292-4840
Nine bills will be heard on Monday by this committee and if the "permit to sell home-baked goods" is approved it will go to the Senate for a vote, otherwise it will just "sit." It is important for NJ supporters of this legislation to turn out for this committee hearing. If you are attending make sure you have identification with you since you will be going through a security check point. Good luck everyone and please report back to us!
